Problem

The mediation was initiated by the company’s management. The dispute concerned copyright in an intellectual product created by the company with the direct involvement of a former employee during their formal employment.

During mediation, it became clear that the product required registration with Rospatent. However, the company had not signed documents confirming that the participating employees created the product as part of their employment. After leaving the company, the former employee demanded substantial compensation for the infringement of their copyright. Rospatent registration was postponed until the copyright dispute was resolved, making the product impossible to sell. Litigation would have exposed the company to reputational risk, legal costs and a significant delay in bringing the product to market.

Within three weeks, the Concord Prism team helped the parties agree that the former employee’s authorship would be acknowledged in all official sources. The compensation agreed with the former employee was reduced fivefold.
